Welcome to Al Mustaqeem.
These Terms & Conditions ("Terms") govern your use of the Al Mustaqeem application and website (the "Platform"),
operated by Almustaqim Establishment For Metals,
registered in the Kingdom of Saudi Arabia under Commercial Registration No. 7042626825.
By creating an account or using the Platform, you agree to these Terms. If you do not agree, please discontinue use of the Platform.
1. About Al Mustaqeem
Al Mustaqeem is a digital marketplace that connects customers seeking metal fabrication, blacksmithing, welding, and laser-cutting services ("Customers") with independent, registered workshops and technicians ("Fabricators") in Saudi Arabia. Fabricators also list fixed-price ready-made products through profile galleries on the Platform.
2. Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts under the laws of Saudi Arabia to use the Platform.
3. How the Platform Works
1. A Customer posts a service request describing the work needed.
2. Registered Fabricators near the Customer submit quotes.
3. The Customer selects a Fabricator and confirms payment.
4. Payment is processed through the Platform's payment partner and held in escrow — it is not released to the Fabricator immediately.
5. The Fabricator carries out the work.
6. Once the Customer confirms the work is complete (or the escrow period defined below elapses without a dispute being raised), funds are released to the Fabricator, less the Platform's commission.
Customers may also purchase fixed-price ready-made products directly from a Fabricator's gallery; these are paid for and processed in the same way, without a quotation step.
4. Payments and Escrow
- All payments are processed through Al Mustaqeem's authorized payment service provider.
- Funds paid by the Customer are held in escrow by the Platform and released to the Fabricator upon the earlier of:
(a) the Customer confirming the service was completed satisfactorily, or
(b) 5 business days after the Fabricator marks the job complete passing without the Customer raising a dispute.
- Al Mustaqeem retains a commission of 5% of the transaction value, deducted before funds are released to the Fabricator.
- The final price and any applicable fees are displayed to the Customer before payment is confirmed. No additional charges are applied without prior disclosure.
5. Cancellations
- A Customer may cancel a request free of charge before a Fabricator has accepted the job and begun work.
- Once work has begun, cancellation may be subject to a partial charge reflecting materials used and work completed, as agreed between the Customer and Fabricator and reviewed by Al Mustaqeem if disputed.
- A Fabricator who accepts a job and later cancels without valid cause may be subject to account review or suspension under Section 13.
6. Refunds
Refund requests are reviewed by Al Mustaqeem, taking into account the status of the service, evidence provided by both parties (photos, messages, delivery confirmation), and these Terms. Al Mustaqeem aims to resolve refund reviews within 5 business days. Approved refunds are processed back through the original payment method via the Platform's payment service provider.
7. Chargebacks
If a Customer files a chargeback claim with their bank or payment provider, Al Mustaqeem may share relevant transaction records, communications, and evidence of service delivery with the bank or payment provider to help resolve the claim.
Where the bank, payment service provider, or Al Mustaqeem's review of the available evidence establishes that the service was provided in accordance with the Customer's request and these Terms, the Customer may be held responsible for a false, improper, or unjustified chargeback claim, including any associated fees.
8. Fraud and Unauthorized Use
Users must only use payment methods they own or are legally authorized to use, and are responsible for activity on their account, except where unauthorized use is established in accordance with applicable law. Al Mustaqeem may suspend an account or transaction where fraud is suspected and may request additional documentation to verify identity or transaction validity.
9. User Responsibilities
- Provide accurate registration and project information.
- Only upload content (drawings, photos, designs) that you own or are authorized to share.
- Use the Platform only for lawful purposes.
10. No Circumvention
Customers and Fabricators who connect through Al Mustaqeem agree not to complete the transaction outside the Platform for the purpose of avoiding the Platform's commission. Al Mustaqeem reserves the right to suspend accounts found to be circumventing the Platform in this way.
11. Fabricators Are Independent
Fabricators are independent businesses, not employees, agents, or partners of Al Mustaqeem. Al Mustaqeem verifies Fabricator registration before listing them on the Platform but does not itself perform fabrication work.
12. Uploaded Content and Intellectual Property
Designs, drawings, and files uploaded by a Customer remain the Customer's property. Fabricators may use uploaded files solely to complete the requested job and may not reuse, publish, or share a Customer's design for any other purpose without the Customer's explicit consent. All Platform content, branding, and software remain the property of Al Mustaqeem.
13. Account Suspension and Termination
Al Mustaqeem may suspend or terminate an account for breach of these Terms, suspected fraud, repeated cancellations, circumvention of the Platform, or unlawful conduct. Where reasonably possible, Al Mustaqeem will notify the user of the reason for suspension and provide an opportunity to respond.
14. Limitation of Liability
Al Mustaqeem operates the Platform, including matching, payment escrow, and dispute review, but does not itself perform fabrication work. Al Mustaqeem is not liable for defects in workmanship, or for delays caused directly by a Fabricator, except to the extent such issues arise from Al Mustaqeem's own failure to properly operate the escrow, payment, or dispute-review process described in these Terms. Nothing in these Terms limits liability for fraud, willful misconduct, or gross negligence by Al Mustaqeem, or any liability that cannot be excluded under Saudi law.
15. Disputes
Customers and Fabricators should first contact Al Mustaqeem support to resolve any dispute regarding a service or payment. Al Mustaqeem will review the evidence provided by both parties and make a determination in line with these Terms. Unresolved disputes are subject to the applicable laws and regulatory authorities of the Kingdom of Saudi Arabia.
16. Changes to These Terms
Al Mustaqeem may update these Terms from time to time. Material changes will be notified to users through the Platform before taking effect.
17. Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia, and any disputes not resolved directly are subject to the jurisdiction of the competent courts of Saudi Arabia.
